Chandigarh-(Gurpreet) -Contempt notices to Civil Surgeon, Hoshiarpur and Executive Engineer, Punjab Health Systems Corporation, Mohali for violating order against cutting of trees :

Justice H.S. Sidhu of the Punjab and Haryana High Court today issued notices for January 17th, 2022, to Dr. Parminder Kaur, Civil Surgeon, Hoshiarpur, and Vijay Kumar, Executive Engineer, Punjab Health Systems Corporation (PHSC), Mohali, in a contempt petition filed by Kuldip Rai Dogra of Mukerian. Mr. Dogra has alleged that he had earlier filed a PIL against proposed cutting of 4 trees standing in the premises of Civil Hospital, Mukerian, in order to expend the emergency block of the Hospital. The HC had disposed the PIL on November 9th, 2021, by giving a direction to the authorities to re-examine the technical feasibility of the project with an object to save the age old trees, if possible.

It is contended in the COCP that earlier on 16th November, 2021, the respondents issued an auction notice for selling those 4 trees, without complying with directions issued by HC. The petitioner again filed PIL against the same, and upon listing of the PIL for hearing on 23rd November, 2021, the respondents assured that auction notice will not be acted upon, rendering the said PIL as infructuous. Now again without examining feasibility of project, the Executive Engineer, PHSC, Mohali, has issued tenders inviting bids for construction / upgrading of building of Civil Hospital, Mukerian.

During hearing of Contempt petition today, the respondents made a statement that they have withdrawn the tender notice, and that they do not intend to auction/cut the trees under reference for the time being. But the Counsel for petitioner contended that the respondents are repeatedly violating the orders of Hon’ble HC, and thus, taking the HC for a ride, and in the circumstances, they deserve to be proceeded against under the Contempt proceedings. Hence, notices have been issued to them to show cause as to why contempt proceedings be not initiated against them for violation of HC orders.
