Demand notice against rallies by ruling political parties


Chandigarh (Global) High court Advocate Hari Chand has sent a demand notice on the issue of Political rallies. He has said that Covid-2019 situation is at its peak. Political rallies are also at its peak. Every political party is exploiting the grievances of farmers, and indulging into one-upmanship against the others to reap political harvest. Such rallies are seeing a spurt. Government of Punjab is not only  a silent spectator to such rallies and dharnas, but is instigating the citizens to participate in such rallies. Hon’ble Chief Minister and his colleague Ministers are participating in such rallies. Thousands of persons are participating in such rallies. Social Distancing norms, and wearing of masks during such rallies is being observed only in breah. Thus, ruling political party is extending open invitation to speed up the spread of Corona-virus. There are chaos in traffic on the roads and Highways. Today’s rally by Shromani Akali Dal was an attempt to show its strength during Covide-2019 situation. It has created panic, with huge traffic of cars and jeeps emerging from all sides of Punjab, for purported “gherao” of Punjab Governor, over the issues of farmers. It has created traffic jams all over Punjab. Mr. Rahul Gandhi is reportedly visiting Punjab in a day or two. His visit will involve misuse of State machinery, Police, and civil administration by ruling political party. No criminal case is being registered against any individual or any organization for blocking railway lines, and disrupting goods or passenger trains within the State of Punjab. It is thus, a complete failure of law and order machinery in the State of Punjab, which should, in ideal situation, invite the imposition of Governor’s Rule in the State.

                   In the circumstances, I would call upon you to ensure that State Machinery should not be misused in political rallies, by ruling political party, or any other political party. Mr. Rahul Gandhi, in his own right, may address any political rally, but Unlock-5 Guidelines must not be violated during such rallies. Ministers, or the Chief Minister must not participate in any such rally, without resigning from their Constitutional posts. In case Constitutional rules of the game are thrown to winds during his proposed rally, and criminal cases are not registered against any body, how so ever high or powerful, he or she may be, who violates the rules or the law, in such event, I shall be left with no other option, except to file a PIL for seeking registration of criminal cases  against all of them.
