PIL against Political rallies and Rahul Gandhi
Chandigarh (Aditi) The Advocate of punjab & haryana High Court Hari Chand has moved a PIL against Rahul gandhi and Political rallies. He has said that the Shromani Akali Dal conducted three political marches from three Sikh Takhats, on route to Chandigarh, disrupting all traffic, and creating chaos on roads in Punjab. Unlock-4 Guidelines were thrown to winds, thereby attracting penal provisions under those Guidelines, but Punjab Police remained a silent spectator, as no FIR was registered against any leader or precipitant of the three rallies 2.10.2020 Tractor rallies under the leadership of respondent no.4 Rahul Gandhi are scheduled to be held in the State of Punjab from 3.lO.2O2O to 5.1O.2O2O, and Punjab Chief Minister, and all Cabinet Ministers of Punjab shall participate in these tractor rallies, which would amount to complete break down of the Constitutional machinery in the State of Punjab, as thousands of political workers, along with Chief Minister/Ministers shall participate in these rallies, in gross violation of Unlock-4 and Unlock-5 Guidelines, and Police will not dare to register any FIR against them.. Besides, it would be gross misuse of tractors, which is not a commercial vehicles. Thus, such rallies deserve to be declared illegal, unconstitutional, being a threat to public order as well.
Relief Sought : Civil Writ Petition (by way of a PIL) under article 226 of the Constitution of lndia, seeking the issuance of a Writ of Mandamus, or any other appropriate writ, direction or
order, or a writ of Prohibition, for banning the political rallies, more particularly by the ruling political party, in the State of Punjab, involving participation of more than 100 persons, and that too, without observing mandatory safeguards, as envisaged under the Unloc k-4 and Unlock-S Guidelines issued by Union of lndia, and more particularly the scheduled tractor rallies of ruling political party, under the leadership of respondent no.4 (Shri Rahul
Gandhi), with Chief Minister himself, and his colleague Ministers, participating in those rallies from 3.10.2020 to 5.10.2020, as that would also result into complete break down of Constitutional machinery of the respondent State of Punjab, as no Police officer can dare to register an FIR against those who violate Unlock-4 and Unlock-S Guidelines ,
AND also to restrain the holding of scheduled tractor rallies of ruling political party in Punjab, under the leadership of respondent no.4 (Shri Rahul Gandhi), with Chief Minister himself, and his colleague Ministers, participating in those rallies from 3.10.2020to 5,LO.2O2O, as an interim measure;
AND to grant any other relief to the petitioner, in public interest, to which he may be found to be entitled by this Hon'ble Court.
