Make Fundamental Duties enforceable in the Courts of Law – Satya Pal Jain


Chandigarh (Aditi) . Sh. Satya Pal Jain, Ex. MP, the Senior Most Member of the Panjab University Senate & Additional Solicitor General of India, has said that the time has come when the Fundamental Duties of a citizen, as enshrined in Article 51-A of the Constitution of India, be also made enforceable in the Court of Law, like the Fundamental Rights of the citizens.Mr. Jain was addressing a webinar organised by “Think India” on the topic “Constitutional mandate of Fundamental Duties & Directive Principles of State Policy as a guide for Nation Building”.

Mr. Jain said that as per Article 51-A of the Constitution of India, there are 11 Duties which are supposed to be performed by each and every citizen of India. Unfortunately, they are not enforceable in the Court of Law. He said that during the last 70 years of independence, people have talked only about the Fundamental Rights but not about the Fundamental Duties.

He said that in coming times, in view of the Covid as well as the increasing threats to internal and external security of India, the Indian citizens will be required more to perform their duties towards the society by accepting and submitting to the guidelines laid down by the Centre and the State Governments. In this view of the matter, the time has come when the Fundamental Duties of a citizen should also be made enforceable in the Courts of Law, by amending the Constitution, so that the Nation as a whole, especially the coming generations, realises the gravity of the situation, the provisions of the Constitution and are made aware of their Fundamental Duties to the nation.
